A FCT High Court in Maitama has removed Donald Duke & proclaimed erstwhile Minister of Information, Prof. Jerry Gana, as victor of the presidential primary race of the Social Democratic Party, SDP, organized on October 6. Duke, an erstwhile Governor of Cross River, was pronounced the champ of the race & the party candidates for next year race.
As indicated by the gathering, Duke gather 812 votes & Gana had 611. Gana question the outcome in court & asked to be announced the victor in accordance with the moving & turning rule of the party’s structure.
Justice Hussein Baba-Yusuf while making the pronouncement on Friday held that the arrangement involved in the party’s structure were authoritative on each part & should be adhere to. As indicated by the judge, the moving & turning rule as included in the party’s structure required that both the administrator of the gathering & the candidates must not originate from a similar area.
“In this instance, the party’s Chairman, Chief Olu Falae, is from the South and Duke is from the South too; the law is clear; there is nothing to write in-between.”
“The law has crystallised that political parties should abide by the regulations which they have made by themselves.”
“The claimant laid sufficient evidence to have the judgment in his favour; it is a clear violation of the party’s constitution; the court cannot wave right over illegality,” he stated.
He at that point announced Gana the champ of SDP presidential primary race. He likewise announced Duke’s 812 votes invalid & requested SDP to send Gana’s name to the Independent National Electoral Commission (INEC) as the gathering’s candidates for the 2019 presidential race.
